BGC Australia and Brickworks have settled a legal dispute in which the latter accused the Len Buckeridge-founded group of predatory pricing.
In a statement to the market, Brickworks this morning announced the case it launched against BGC (Australia) and BGC subsidiary Midland Brick had been settled.
The matter was initially scheduled for a five-week hearing in the Federal Court of Australia in June.
“Brickworks today announces that both parties have agreed to have the proceedings dismissed without liability to the other party,” Brickworks’ statement reads.
BGC released a statement over the full and final settlement of the legal proceedings.
"We are pleased with the outcome and that this is behind us," BGC chief executive Daniel Cooper said.
It comes after Brickworks updated its shareholders last month, saying there were upcoming milestones in the case including expert reports to be submitted.
Brickworks spent $13 million in legal costs, according to its 2025 half-year report.
In September 2023, Brickworks launched legal action against BGC (Australia) and Midland Brick in the Federal Court’s New South Wales registry.
Brickworks reportedly claimed damages and orders requiring BGC to divest Midland Brick.
The claims reportedly revolved around allegations of predatory pricing in the clay bricks market in Western Australia.
Brickworks and BGC Australia were WA’s only two brick manufacturers, with the latter holding a significant majority market share after acquiring Midland Brick.
It has also been alleged that BGC’s acquisition of Midland Brick in 2021 breached the Competition and Consumer Act, as previously reported in the media.
In its statement, BGC said the acquisition was cleared by the Australian Competition and Consumer Commission in December 2020, and was completed in April 2021.
"Since then, BGC has continued to invest in Midland Brick, increasing production in Western Australia and serving its diverse customers," the statement reads.
Brickworks exited the WA market in April 2023, after posting losses from its businesses in the state.
